Please read this service agreement (“agreement”) prior to registering for a SERV account. SERV is a mobile app, owned and maintained by ERA Environmental Consulting, Inc. By creating a SERV account you agree in full to the following terms and conditions.

1.     Intellectual Property

1.a SERV Content

SERV’s name, emblem, and in-app elements (images, video, photographs, or trademarks) are the exclusive property of SERV and ERA Environmental Consulting, Inc. and are protected under international law. Unauthorized use of SERV property is prohibited.

1.b Your Content

SERV does not claim ownership of your Content (as defined by data entered into the SERV app or website, in addition to images, written content, articles, requests, or responses). However, when you post Content on any SERV properties you agree that you own and have license to use publish, license modify, translate or distribute that information AND you grant permission to SERV to publish/display that data within the SERV environment to other users as well as other forms of media including websites and brochures. Please remember that other users may search for, see, and reference any Content that you submit to the “public” area of the SERV database. You agree that You, not SERV, is responsible for the validity and disclosure of any Content you make available. SERV has no obligation to pre-screen, monitor or enforce your intellectual property rights to your User Content. We may (but have no obligation to) review, monitor and reject any User Content. Further we may, in our sole discretion, delete or format for purpose of publishing without altering the data’s integrity of your User Content without notice or liability.

1.c Sharing, Recognizing, and Disclosing Your Contributions via the Recognition Program

SERV does not claim ownership of your content, logo, brand materials, or any contributions that you enter into the SERV database. SERV provides the option for users to share, publish, or otherwise disclose your social sustainability contributions in order to promote users’ and user organization’s  with publicity and recognition for their projects, including (but not limited to): achievements, name and/or logo inclusion in contributor lists, users/logos feature spotlights within the app, logos featured in promotional materials including brochures, and other media releases as contributors. Users must opt into this Recognition Program in order to enjoy the recognition and other benefits.

To opt into the Recognition Program please enter the email connected to your SERV account and check the box. By opting in you agree that your organization’s contribution records, name, and/or logo may be featured in the above-stated recognition materials.

2.     Service Rules

You agree not to engage in any of the following prohibited activities:

  1. Using the SERV platform for commercial purposes including soliciting or advertising for-sale products;
  2. Copying, distributing, or disclosing any SERV Content using any automated “scraping” tool;
  3. Using any automated system including “robots,” “spiders,” “offline readers” for the purpose of sending more requests or submissions thana human could reasonably produce in the same period of time;
  4. Attempting to interfere with, or compromise the integrity or security of the platform, or attempt to decrypt any secure transmissions to or from the servers;
  5. Uploading invalid data, viruses, worms, or other software agents, or providing links to any of these types of agents;
  6. Impersonating another person or otherwise misrepresenting your organization or committing fraud;
  7. Posting Content containing illegal subject matter including hate speech, making threats, or inciting violence;
  8. Engaging in or promoting any contests, junk email, pyramid schemes, spamming or other solicitation;
  9. Copy, adapt, or attempt to reverse-engineer the object code of the Application’s software, HTML, JavaScript, or other programming code.

 

3.     Creating an Account

In creating a SERV account, you agree: (1) to provide true, accurate, and complete information about yourself as prompted by the service’s registration form; (2) that you are at least eighteen (18) years of age and of legal age to form a binding contract; (3) you are a current employee of the organization you are creating an account under (when applicable); (4) are not barred from volunteering or working with youth or vulnerable persons under the laws of your local jurisdiction. You agree not to create an Account using a false identity or information, or on behalf of someone other than yourself. You agree that you shall not have more than one Account per platform. You agree not to create an Account or use SERV if you have been previously removed by SERV, or if you have been previously banned from any of the SERV.

If you are using the Services on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to these Terms.

4.     Third Parties

 

4.1 Donations and Volunteer Requests

SERV does not guarantee that any donations collected or requested, or volunteer opportunities published via SERV will be used for any particular purpose and SERV shall not be responsible for the management, handling, or success of any projects tracked or shared using SERV. SERV is solely designed to communicate donations, requests for donations, and to connect those seeking services or volunteering with those offering them, as such SERV is not liable for the quality,  safety, authenticity, or accuracy of these services. Please note that recipient organizations reserve the right to use your donations for their general purposes in accordance with their own practices and rules. SERV does not hold responsibility to verify requests for donations or volunteers prior to or after publication of said requests.

The User acknowledges and agrees that: (i) donations are at User’s own discretion and risk; and (ii) we have no liability whatsoever for (a) any loss the User may suffer if a third party obtains unauthorized access to any information provided by the User and (b) any act or omission by the User’s financial institution, credit card or other payment method provider, telecommunications services providers or any third party in connection with the donations to SERV and transactions related thereto.

4.2 Third Party Links and Content

SERV may host links form other applications within the SERV or User Content including links to external websites. SERV may also include third-party content which we do not control, maintain, or endorse.  Accessing any of these third-party sites or applications will require you to leave the SERV application. The user expressly acknowledges and agrees that SERV has no liability for the consequences resulting from engaging with any third party. Any communications, agreements, or transactions with third parties is solely between yourself and the third party.

5.     Limitation on Liability

SERV is provided “as is” and “as available”, without warranty of any kind. We periodically change and modify the service. We reserve the exclusive right in our sole discretion to (i) alter, limit or discontinue the Service in any respect; (ii) deny user access to the Service without notice (iii) modify these general Terms of Use.

Under no circumstances shall SERV, its staff, officials, employees, information or content providers be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of the Service, including, without limitation, any fault, inaccuracy, error, omission, interruption or delay deletion, defect, alteration or use, with respect thereto, infection by virus or any other contamination of by anything which has destructive properties, communication line failure, regardless of cause. Under no circumstances, including but not limited to negligence, shall SERV be liable for any direct, indirect, incidental, special or consequential damages, even if SERV has been advised of the possibility of such damages.

6. Updates to Terms

We reserve the right to modify or add to these Terms or any Additional Terms, at any time without prior notice. You agree that we may notify you of the Updated Terms by posting them on the Application so that they are accessible via a link on the home page of the Application, and that your use of the Application after we have posted the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms.

7.     Privacy Policy

7.1 Handling of Private Data

SERV operates in accordance with the GDPR standards of data privacy and ownership. These standards support transparency in which data SERV collects when you visit our website, how we use that data, and your rights of ownership over that data.

  1. You have the right to request access, free of charge and with reasonable expectation of response time, to the personal information we process about you.
  2. You have the right to request we correct inaccurate or incomplete personal information about you.
  3. You have the right to request that we delete personal information about you.
  4. You have the right to request restrictions on our processing of information about you.
  5. You have the right to have personal information about you transferred to yourself or to a third party based on your consent.
  6. You have the right to opt out of communications or our use of your information.

To use SERV you are required to register and provide certain information to us so that we can do our job. To obtain information from us you may be asked to provide certain non-public, personal information such as e-mail, name, mailing address and telephone number. We will use that information to respond to your requests. Our web servers may also collect general information that does not relate to individual visitors. This information such as number of pages viewed, number of visits to the site, and the domains from which people access our site is used to evaluate and improve our web site.

Personal information collected by your employer is under the jurisdiction of said employer and it is their responsibility to manage your information according to the relevant regulations. SERV will act in accordance with all relevant regulations we process for purposes of SERV technical support, and will likewise act as a data service provider in other cases where the ownership and processing authority belongs to the client organization.

7.2 Password protected Websites and Portals

ERA Environmental customers access the ERA EMS Platform through a password protected website. We may also make available additional password protected sites for customer support and partner support purposes. Before accessing these sites, you may be asked to provide information such as name, business affiliation, e-mail address, mailing address, telephone, or customer number to obtain access credentials. This information is used to determine your eligibility for viewing or use of controlled content. If you choose not to supply the requested information, SERV may deny you access to some or all portions of our password protected sites.

7.3 Security

We strive to ensure the integrity and security of your information. ERA Environmental Consulting Inc. has adopted reasonable electronic and managerial procedures and policies to safeguard your personal information against unauthorized disclosure.
